By subscribing to or using our Services, you agree to be legally bound by these Terms. If you do not agree, you must not use the Services.
Important Notice
These Terms of Service govern your access to and use of AIRE CRM software, mobile applications, and related services provided by AIRE, powered by Cypheria AM Pvt Ltd.
1. Definitions
• Account – The user profile created to access Services.
• Subscription – A paid license granting access to Services for a specified duration.
• Service Data – All information, leads, contacts, and content uploaded or generated by you within A.I.R.E.
• Confidential Information – Any non-public information shared between you and A.I.R.E.
2. Eligibility
• You must be at least 18 years old to subscribe.
• If you are entering into this agreement on behalf of an organization, you represent and warrant that you are authorized to bind that entity.
3. Account Registration & Security
• Users must provide accurate, complete, and updated information when registering.
• You are responsible for maintaining the confidentiality of login credentials.
• Any activity under your account will be considered authorized by you.
• A.I.R.E shall not be liable for unauthorized access resulting from your failure to secure your account.
4. Subscription, Fees, and Payments
• Subscriptions are billed in advance on a monthly or annual basis.
• All fees are non-refundable, except as permitted under our Refund Policy.
• Taxes, duties, and charges imposed by law are your responsibility.
• We may revise pricing with 30 days' notice. Continued use constitutes acceptance.
5. License of Use
• A.I.R.E grants you a limited, non-exclusive, non-transferable, revocable license.
• You may not: Sublicense, sell, or resell the Services.
• Reverse-engineer, modify, or attempt to copy source code.
• Circumvent security measures or use for unlawful purposes.
6. User Responsibilities
• Use Services in compliance with applicable laws, including data protection.
• Obtain necessary consents before uploading customer data.
• Not engage in spam, phishing, or fraudulent activities.
• Not upload viruses, bots, or malicious code.
7. Service Availability & SLA
• A.I.R.E strives for 99.9% uptime annually.
• Scheduled maintenance may result in temporary downtime with prior notice.
• We disclaim liability for downtime due to force majeure, third-party failures, or internet disruptions.
8. Data Ownership & Confidentiality
• You retain ownership of all Service Data uploaded into A.I.R.E.
• A.I.R.E processes Service Data only to provide Services, as detailed in our Privacy Policy.
• Both parties shall treat each other's Confidential Information with the same care as their own.
9. Intellectual Property
• All IP rights in A.I.R.E's software, trademarks, and logos remain our exclusive property.
• Except for the limited license granted, these Terms do not transfer any IP rights to the User.
10. Termination & Suspension
• You may terminate your subscription at any time per the Refund Policy.
• We may suspend/terminate for: Unpaid fees, breach of terms, or illegal activities.
• After 30 days of termination, data will be permanently deleted.
11. Limitation of Liability
• A.I.R.E shall not be liable for indirect, incidental, or consequential damages.
• Aggregate liability shall not exceed the total subscription fees paid in the preceding three (3) months.
12. Indemnification
• You agree to indemnify A.I.R.E from claims arising from: Misuse of Services, violation of Terms, or infringement of rights.
13. Compliance & Data Protection
• Users are solely responsible for ensuring compliance with GDPR, CCPA, or other laws.
• A.I.R.E acts as a Data Processor and follows industry security standards.
14. Governing Law & Jurisdiction
• These Terms shall be governed by the laws of India.
• For UAE users, UAE laws shall apply.
• Disputes are subject to the exclusive jurisdiction of courts in [Insert City/State].
15. Force Majeure
• A.I.R.E shall not be liable for failure to perform due to events beyond reasonable control (natural disasters, cyberattacks, outages).
16. Amendments
• A.I.R.E may update these Terms periodically.
• Significant changes will be communicated 30 days prior to enforcement.
• Continued use after updates constitutes acceptance.
